No will, and a second probate nobody had noticed

A triplex in Little Havana in need of repairs, and three siblings who had come into it when their parents died. There was no will.

Without one, the estate has to go through probate before anybody has the authority to sell. That much they were expecting. What came out of the discovery was that there were two probates to complete, not one.

This is worth explaining, because it catches families constantly. When both parents have died, the first death often went unhandled. Nothing looks wrong at the time — the surviving parent carries on living in the house and life continues. But the first parent’s interest never actually passed anywhere. So when the second parent dies there are two estates sitting on the same property, and both have to be opened before anyone can sign a deed. People find this out at the worst possible moment, which is when they have already decided to sell.

Two probates take longer than one, and a property does not pause while they run. The taxes were falling behind.

So we paid the up-front costs to get the probate started, because nothing moves at all until somebody funds the filing. And we covered the back taxes as they came due through the process rather than only at closing — a long probate with unpaid taxes accruing underneath it is exactly how a family loses the asset they are in the middle of inheriting.

Then we got two of the units rented.

That one needs saying properly, because it is not the usual arrangement. We did not own the building. The probates were still running. But a triplex standing empty through a long probate produces nothing for the people waiting on it while the costs carry on regardless. Two tenanted units meant the family had income during the wait — money coming in to help carry the property and their own bills, instead of a year of outgoings with nothing against them.

None of that was a favour and none of it was clever. It is the difference between a family waiting out two probates with an empty building draining them, and a family waiting out two probates with the building paying for part of it.

Five buildings at once, and a daughter doing it full time

A man died and left five multifamily buildings across Little Havana to his children. An eighteen unit building, a twelve unit, an eight plex, a fourplex and a triplex — forty-five units in all. Five buildings is not five times one building. It is a portfolio, and the people who inherited it were not multifamily operators. Nobody had chosen this line of work.

The forty year certifications came due at around the same time, which is what happens when buildings are bought over a few years — they age together, so the deadlines arrive together. Insurance was climbing at the same time, on all five.

They did the thing that looks sensible from the outside and took out a hard money loan to get ahead of it. Hard money is short term by design and expensive by design. It works when the plan underneath it runs to schedule.

The plan did not run to schedule, and they seldom do. General contractors do not always do what they said they would, in the time they said it. City inspectors turn up when they turn up, and will write you a citation for drywall repairs while they are there. Neither of those is a scandal — it is the ordinary friction of this work. But ordinary friction is enough to break a timetable that has a loan sitting on top of it.

So every month the insurance went out, the debt service went out, and money went into stabilising buildings that were not yet stable. Five times over. They were losing money every month, and the losses were paying for a finish line that kept moving.

One of the daughters was carrying all of it. It had become her full-time job — the contractors, the inspectors, the certifications, forty-five units’ worth of it. The family could not pay her, because the money that would have paid her was going into the buildings. So she was working full time, unpaid, at something that was not her career and was not going to become it, and she could not get on with her own life while it carried on.

At that point selling was simply the easiest thing for all of them, and they were right about that.

What the family got was the monthly bleed stopping on the day we closed, which is the part that gets talked about. What the daughter got was her time back. That does not appear anywhere in a sale contract, and by then it was most of what was actually at stake.
